(a) Authority of Department Head. Personal property not needed for municipal purposes, the estimated value of which is less then five thousand dollars, ($5,000) may be sold by the department or division head having supervision or management over said personal property, upon written approval obtained from the Mayor and Finance Director. Prior to the transfer of any property, department heads shall be responsible for the removal of logos, seals, emblems or other marks identifying the equipment as the property of the Village.
Except for property sold at public auction, a list of items sold, their general condition at the time of sale, the name of the purchaser, the purchase price and the reason for declaring the items available for sale shall be maintained in the Mayor's office and shall be available for public inspection.
(b) Public Sale Without Bid. For those items having an estimated value of One Hundred Dollars, ($100.00) to Five Thousand Dollars, ($5,000.00), a notice of the item for sale, its general condition, who to contact regarding submission of an offer and the date by which an offer must be made shall be posted in the lobby of the Village Hall no less than ten (10) working days prior to the final date on which offers are accepted. Said department head having supervision or management over said property may, at his discretion, cause a notice to be published in a newspaper printed and of general circulation for up to two (2) consecutive weeks advertising the sale of this property. In the event more than one (1) offer is received, the personal property shall be sold to the highest and most reasonable offer accepted.
(c) Public Auction. If the estimated value of such property is equal to or exceeds Five Thousand Dollars, ($5,000.00), it shall be sold only when authorized by resolution of Council and approved by the department head having supervision or management of such personal property. When such authorization is obtained, the department head shall sell the personal property to the highest bidder after advertisement in a newspaper of general circulation for two (2) consecutive weeks. Such advertisement shall specify a description of the property, who to contact for submitting bids, the date of the closing for receipt of bids, and the date and place said bid will be awarded. The department head is authorized to establish a minimum bid which may be submitted. Sealed bids shall be submitted in writing by the closing date established by the department head. The department head shall also establish the date and place for opening the bids. The department head shall award the sale to the highest and most reasonable bidder.
(d) A written report of the sale shall be submitted by the department head to the office of the Mayor who shall then compile this information into a report of all such sales.
(e) In the event no bids are submitted, the department head shall made necessary arrangements for the sale of personal property by private sale. In the event the department head is unable to obtain bids for private sale, the department head shall make necessary arrangements for the disposal of the equipment or property.
(f) All monies collected from a sale or said personal property shall be turned over the to Director of Finance to be placed in the General Fund of the Village with a detailed explanation of the source.
