951.04 SCHEDULE OF FEES FOR SHAKER HOUSE RENTALS.
   (a)   The following Schedule of Fees is hereby established for the use and rental of the Shaker House Residential Rentals and the Highland Hills Government Office Complex and Community Center or portions thereof:
      (1)   For lease of residential housing, rents shall be according to the following schedule :

         C.   Upon approval of the Mayor, the Director of Properties may establish an increase in the above approved rent amounts by up to five percent (5%) on an annual basis, provided that the Director conducts a study of market rents in the area and such increase will place the value of rents below the market rate for one bedroom apartments. Any such increase shall be placed in writing, attested by the Law Director, approved by the Mayor, and a copy of said report shall be served on the Clerk of Council prior to January 31 of each calendar year.
      (2)   A Security Deposit shall be collected at the time of receipt of an application for lease and approval of the application by the Mayor, and/or his designee . The security deposit shall be equal to one month's rent.
      (3)   Any deposit collected with the first month's rent for any residential housing is subject to be refunded pursuant to the terms and requirements of ORC 5721, et seq. less any damages that must be repaired by the Village of Highland Hills upon the tenant vacating the premises.
      (4)   For lease of commercial office space.
         A.   Cost per square footage: $8.00 to $16.00 per square foot within the range established above based upon the prevailing factors, etc.
         B.   The Mayor, and/or his designee shall have authority to negotiate the best and reasonable price per square foot based upon the prevailing factors determining the cost per square foot of lease of commercial space.
      (5)   Charges for appliances shall be $10.00 per appliance per month. (Refrigerator, TV)
      (6)   For use of the banquet facilities:
         A.   For use for one calendar day or any portion thereof:
            Ballroom B & C $800.00 (Both B & C)
            Ballroom $400.00 (for B or C)
A deposit of $200.00 shall be collected at the time of acceptance of the rental application to hold the rooms rented. Said amount shall be charged in addition to the rental charge and is subject to being refunded to the lessee after the rental to protect against any damages or extraneous costs to the Village.
      (7)   For use of conference facilities or meeting rooms:
         A.   For use for one calendar day or any portion thereof:
            Maximum $200.00 per day for any conference facility or meeting room.
   (b)   The Mayor, and/or his designee, may waive any rental charge for recognized community or civic groups conducting organizational activities that do not include party activities or celebrations.
   (c)   In any case in which the Mayor, and/or his designee , in his or her discretion, may determine that the payment of the above Schedule of Fees for use of the banquet facility only by an organization would work a hardship upon such organization, and that it would not be to the detriment to the community to permit the use of the municipal building and/or ballroom facilities without the payment of the fee upon application for waiver of the fees by the organization, the Mayor, and/or his designee may waive, in writing, the payment of the fees established herein.
   (d)   A deposit of $100.00 shall accompany the application agreement and will be retained to cover any damages or additional cleaning charges after the event. The balance shall be refunded upon approval of the Mayor, and/or his designee after deducting any amounts due for rental, damages, labor or equipment as set forth in Section 951.02(e).
   (e)   The Village, through the Office of the Mayor, and/or his designee reserves the right to deny permits or agreements for the use of any such facility for any activity considered unlawful or improper.
   (f)   Residents and Employees of the Village of Highland Hills shall receive a discounted rate of 25% on the rental of the Shaker House Ballroom. This discount is limited to one time per year. (Ord. 2018-38. Passed 12-12-18.)
