Any person violating any provision of this chapter shall be guilty of a misdemeanor of the third degree for a first offense and thereafter, guilty of a misdemeanor of the first degree for each subsequent offense and the costs of Court incurred in the prosecution of any violation. Each person shall be sentenced as specified in Section 303.99. A separate offense shall be deemed committed each day during or on which a violation continues or occurs. In addition to the penalties provided for hereinabove and Court costs, the person charged with violating any provision of this chapter shall be required to make restitution for any damage to trees by replacing the tree or trees in question with a tree of suitable size and species which may be recommended by the Public Works Director. Each such tree affected by the non- compliance with this chapter shall constitute a separate violation of this chapter.
