(a) No person, other than an employee of the Village of Hicksville, shall dig, excavate or otherwise make any opening in any part of any right-of-way of the Village of Hicksville, unless a permit to make such opening has been issued in the name of the Village Administrator, at least 48 hours in advance of any such opening. This section shall not apply where public safety requires immediate action, but, in all such cases, a permit must be obtained as soon as possible after the opening is made to avoid penalty.
(b) Permits for making openings in a Village right-of-way shall be issued in the name of the Village Administrator and shall be issued by the Village Administrator or the Village Zoning Inspector. Applicants shall complete the permit application form and shall provide the Village with the following information:
(1) The name and address of the person or entity to perform the work;
(2) The purpose of the opening;
(3) The date(s) when the construction shall take place; and
(4) A drawing demonstrating where the opening will be made.
(c) No permit shall be issued until the applicant provides all of the information set forth in division (b) above, pays of an application fee in the amount of ten dollars ($10.00), to cover the expense of the Village inspecting and supervising the opening and restoration of the right-of-way, and the applicant provides the Village certificates of insurance evidencing that the person or entity performing the opening has liability insurance coverage standing alone or with one or more policies of excess or umbrella coverage, providing a combined single limit of coverage for bodily injuries, death and property losses occasioned by the occurrence of any insured event of not less than one million dollars ($1,000,000).
(d) The person or entity performing the opening shall be responsible for restoring, backfilling, tamping and resurfacing, if necessary, any opening or excavation at the earliest possible time upon completion of the need for said opening.
