(a) Definition. A "private swimming pool" shall be any pool, lake, pond, or open tank which is not located within a completely enclosed building and which is:
(1) Capable of containing water to a depth, at any point, in excess of two feet; or
(2) Has a diameter of greater than 12 feet or an area of greater than 100 feet.
(b) No private swimming pool shall be allowed in any commercial or residential district, unless it complies with the following conditions and requirements:
(1) The pool is intended and is to be used solely for the enjoyment of the occupants of the property on which it is located;
(2) The pool, including any walks or paved areas or accessory structures adjacent thereto, is located not closer than ten feet to any property line;
(3) The pool, or the entire property on which it is located, shall be walled or fenced so as to prevent uncontrolled access by children from the street or from adjacent properties. The wall or fence shall be at least six feet in height and shall be maintained in good condition with a gate and lock.
