925.06 DRILLING NEW WATER WELLS.
   (a)   For the quantitative and qualitative protection of the water supply of the Village (to prevent unnecessary waste of water and the pollution thereto and to protect the integrity of the waste water treatment system and the surface drainage system), the drilling of water wells within the Village is prohibited except under the following conditions:
      (1)   For residential household use where determined by the Village that it is not feasible to supply water by extension of Village water mains. Such water shall be discharged in a manner approved by the Village Administrator or his or her appointed representative, which manner shall be to a pond, or by surface drainage (storm sewers if available), creek, stream or river.
      (2)   Where the water is used for geothermal (heating and/or cooling) purposes. No water drawn from such a well shall be consumed or used for any other purpose than for geothermal purposes. Any well drilled pursuant to the installation of a geothermal or similar heating and/or cooling system must be a closed system and said system shall be in compliance with all local, State and Federal laws including all regulations of the State and Federal environmental protection agencies.
      (3)   Where the water is to be used for industrial purposes as part of the industrial process. No water drawn from such a well shall be consumed or used for any other purpose. Such water shall be discharged in an uncontaminated condition and in a manner approved by the Village Administrator or his or her appointed representative, which manner shall be by surface drainage (storm sewers if available), creek, stream, or river.
      (4)   Where the water is to be used for Village purposes.
   (b)   Any person or property owner desiring to drill a water well within the Village shall first make an application for a permit and obtain a permit from the Village Administrator. At the time the application for a permit is filed with the Village Administrator, the person or property owner filing said application shall pay a non- refundable fee in the amount of thirty dollars ($30.00). The application for a permit shall contain, at a minimum, the following information:
      (1)   The name, address and telephone number of the owner of the land upon which the well is to be drilled;
      (2)   The date the proposed drilling of the well is to commence;
      (3)   The location and size of the well;
      (4)   The proposed purpose of the well and the applicant's plans to handle the discharge and runoff of the water generated from said well; and
      (5)   The name of the contractor that will be drilling said well.
   (c)   In the event that the applicant fails to provide any of the requested information or if the proposed plans for handling the discharge and runoff of the water generated from the well do not adequately protect the Village's water supply system or water treatment and surface drainage facilities, the Village Administrator shall have the authority to reject the application and/or request the applicant to make certain changes to the submitted plan for handling the discharge and runoff of water prior to issuing a well digging permit.
