925.04 CONSERVATION MEASURES.
   (a)   When conditions warrant, the Water Management Task Force, established in Section 925.03, may establish water conservation conditions set forth as follows:
      (1)   Condition one: voluntary water conservation. Condition one will be set whenever conditions are such that will cause a water shortage if left to continue. Condition one will be a voluntary ban on all outdoor usage.
      (2)   Condition two: mandatory water conservation. Condition two will be set whenever conditions are such that a water shortage is present and water usage must be reduced to ensure that the residents and businesses of the Village can operate normally. Condition two will be a mandatory ban on all outdoor water use with the exception of the following:
         A.   Irrigation for the production of food and the maintenance of pets and livestock;
         B.   Watering by commercial nurseries at a minimum level to maintain stock (to the extent that other water sources are not available or feasible);
         C.   Watering by arboretums and public gardens of national, State or regional significance where necessary to preserve specimens;
         D.   Operation of Municipal swimming pools or pools used by health care facilities for patient care and rehabilitation;
         E.   Use of fire hydrants for firefighting and health protection purposes (if specifically approved by local health officials and the local governing body);
         F.   Flushing of sewers and hydrants to ensure public health and safety (if approved by the local governing body); and
         G.   Makeup water for air-conditioning cooling towers or refilling (specifically approved by health officials and the local governing body) after draining for health protection or repair purposes.
      (3)   Condition three: emergency water conservation. Condition three will be set when conditions are such that the Village water supply has been reduced to a level at/or below that needed for the health and safety of the residents of the Village. Condition three will be a ban on all water usage within the Village except water for sanitation and safety purposes.
   (b)   For violations of this section, the following shall apply:
      (1)   A first violation of the restrictions imposed under condition two and/or condition three shall result in an emergency water surcharge of twenty-five dollars ($25.00).
      (2)   A second violation of the restrictions imposed under condition two and/or condition three shall result in an emergency water surcharge of fifty dollars ($50.00).
      (3)   A third violation of the restrictions imposed under condition two and/or condition three shall result in an emergency water surcharge of one hundred dollars ($100.00).
      (4)   If the violation continues after notice of violation, the Water Department may disconnect water service to anyone found violating the water conservation measures established according to the conditions set by the Water Management Task Force. Upon application for reconnection, normal disconnection and reconnection fees will be applied.
