921.02 SURFACE AND GROUND WATER PROHIBITED.
   (a)   Definitions.
      (1)   "Sanitary sewage system" means all facilities for collecting, pumping, treating and disposing of sanitary sewage and industrial wastes.
      (2)   "Council" means the Council of the Village of Hicksville, Ohio, or its authorized representatives.
      (3)   "Combination wastes" means the combination of the sanitary sewage and industrial wastes carried from residences, business and commercial establishments, institutions and industrial establishments together with such ground, surface and storm water as may be present.
      (4)   "Sanitary sewage" means domestic wastes contributed by reason of human occupancy.
      (5)   "Industrial wastes" means liquid wastes from industrial processes as distinct from sanitary sewage.
      (6)   "Sewer" means a pipe or conduit for carrying sanitary sewage, industrial wastes or storm water.
      (7)   "Public sewer" means a sewer in which all owners of abutting property have equal rights and is controlled by public authority.
      (8)   "Sanitary sewer" means a sewer which carries sanitary sewage and industrial wastes and in which storm, surface and ground water are intentionally prohibited.
      (9)   "Storm sewer" or "storm basin" means a sewer which carries storm and surface water and drainage, subdrainage ground water and unpolluted industrial waste water, but excluding sanitary sewage industrial wastes.
      (10)   "Combined storm and sanitary sewer" means a sewer which carries sanitary sewage, industrial wastes and storm, surface and ground water.
      (11)   "Newly developed areas" means unsewered areas and areas redeveloped through urban renewal or other similar programs.
      (12)   "Person" means any individual, firm, company, association, society, corporation or group.
      (13)   "Shall" is mandatory, "may" is permissive.
   (b)   Prohibited Discharges. No person shall place, deposit or permit a connection of roof downspouts, exterior foundation drains, areaway drains, or other sources of surface runoff or ground water which are connected directly or indirectly to a public sanitary sewer.
   (c)   New Sewer Construction.
      (1)   No person shall construct any combination storm and sanitary sewer in any newly developed areas in the Village. The Village shall not accept any sanitary or industrial wastes from any developed areas unless separate sanitary and storm drainage systems are constructed in the newly developed areas.
      (2)   The building sewer shall be of the best quality vitrified clay pipe (ASTM C-12 Standard Strength or ASTM C-200 Extra Strength) with precast plastic or O-ring joints (ASTM C-325, and manhole joints C-433); or of asbestos element pipe (ASTM C-428) with couplings of the sleeve-type, with pure rubber gasket (ASTM C-1869); or of cast iron soil pipe (ASTM A-74) with joints complying with applicable plumbing code requirements.
   (d)   Existing Roof Drain. No roof shall be connected to the sanitary sewer system of the Village. Any roof drains now connected to any sanitary sewer shall be removed by the property owner.
   (e)   Enforcement. Council, or its authorized representative, is hereby charged with the enforcement of this section. Council, or its authorized representative may conduct such surveys as may be necessary to detect any existing connection of roof drains to sanitary sewers, and shall be permitted to enter upon all properties for the purpose of inspection, observation, and testing in accordance with the provisions of this section.
