921.01 CONNECTIONS TO SEWERAGE SYSTEM REQUIRED; PROCEDURES.
   (a)   No owner, agent, lessee, tenant or occupant of any lot or land located within the Village shall establish, construct, maintain or permit to remain on any such lot or land any privy, cesspool or other receptacle for sewage or excreta, or a connection to a private sewer, ditch or other outlet, if such lot or land is accessible to a public water main or other water supply satisfactory to permit the use of plumbing is available. When such public sewer and water main or other water supply are available or hereafter made available, a connection to such public sewer shall be established and used by such owner, agent, lessee, tenant or occupant.
   (b)   The owner, agent, lessee, tenant or occupant of any lot or land located within the Village shall maintain at his or her expense the line which services any such lot or land, from the connection with the Village main, including the sewer tap.
   (c)   Whenever the owner, agent, lessee, tenant or occupant of any such lot or land is required to excavate across or under a road or curb, the owner, agent, lessor or occupant shall post a bond in the following amounts to secure the performance of the work:
      (1)   One thousand five hundred dollars ($1,500) for any curb excavation;
      (2)   One thousand five hundred dollars ($1,500) for any road excavation;
   (d)   If a project requires the excavation across or under a road or curb, said road or curb shall be repaired by the owner, agent, lessee, tenant or occupant to Ohio Department of Transportation specifications within forty-five (45) days of the excavation. If there are reasons outside the control of the owner, agent, lessee, tenant or occupant that justify a delay in the repairs, this information shall be communicated to the Village Administrator who shall have the sole discretion to determine whether an extension of time shall be granted to complete the repairs and the length of any extension.
   (e)   All bonds shall be refunded only upon the completion of the repair work, which shall be inspected and approved by the Village Administrator and/or the Village Building and Zoning Inspector. In the event that the owner, agent, lessee, tenant or occupant fails to complete the appropriate repair work in a timely manner or fails to communicate with the Village Administrator regarding delays in meeting the repair deadline, the Village Administrator shall have the sole discretion to declare the bond forfeited and use the bond money to pay for the repairs
   (f)   All new or replaced sewer lines shall be a minimum of four (4) inches in diameter and connected on the top/center of the Village sewer main. Exceptions to this manner of connection will be permitted only where there is sufficient fall from the lot or lands to the Village sewer main.
   (g)   All sewer taps will be inspected and approved by appropriate Village personnel. The owner, agent, lessee, tenant, and/or occupant of any lot or land that is being connected to the Village sewer shall be responsible for having the sewer tap installed and any cost associated with the installation of the sewer tap including the cost of the tap.
   (h)   No tap shall be directly connected to a manhole. All taps shall be connected directly to the Village sewer main.
