147.01 VACATIONS.
   (a)   Each full-time hourly paid employee of the Village shall be entitled to one week vacation with pay, provided he or she has been employed by the Village for one full year. A full-time hourly paid employee with two years or more continuous service shall be entitled to a two-week vacation with pay. A full-time hourly paid employee with eight years or more continuous service shall be entitled to a three-week vacation with pay. A full-time hourly paid employee with fifteen years or more continuous service shall be entitled to a four-week vacation with pay. A full-time hourly paid employee with twenty-five years of service shall be entitled to a five-week vacation with pay. Such vacation leave shall accrue to the employee upon each successive annual reoccurrence of the anniversary date of his or her employment provided the anniversary date may be deferred because of periods of the time during which the employee is not in active pay status. Days specified as holidays by the Village shall not be charged to an employee's vacation leave. Vacation leave shall be taken by the employee during the anniversary date of his or her employment, provided the appointing authority may, in special meritorious cases, permit each employee to accumulate and carry over his or her vacation leave to the following year. No vacation leave shall be carried for more than two years. “Continuous service” means that the employee shall have worked at least 1,600 hours per year. Such 1,600-hour requirement shall include all time an employee is on sick leave.
   (b)   Upon separation from service, except for cause, an employee shall be entitled to compensation at his or her current pay rate for the pro-rated portion of any earned but unused vacation leave for the current year to his or her credit at the time of separation and, in addition, shall be compensated for any unused vacation leave accrued to his or her credit with permission of the appointing authority for two years immediately preceding the last date of his or her employment.
   (c)   In the case of death of any employee, unused vacation leave accrued to his or her credit, with permission of the appointing authority, for the two years immediately preceding his or her last anniversary date, the pro-rated portion of his or her earned but unused vacation leave for the current year, and any unpaid overtime to the credit of any employee shall be paid in accordance with Ohio R.C. 2113.04.
   (d)   The Fiscal Officer shall be authorized to pay vacation pay in the last pay check for the employee, which is issued to such employee immediately prior to the start of his or her vacation, with the approval of the responsible administrative official.
   (e)   Any person employed as a part-time employee of the Village after January, 1997, and who subsequently obtains full-time employee status with the Village, shall be entitled to have his or her prior service from January 1, 1990, with the Village computed and counted as service with the Village for the purpose of computing the amount of vacation leave and for the purpose of computing the anniversary date of hire. For the purpose of this subsection, “prior service” shall include all part-time or full-time service with the Village from and after January 1, 1990.
