(a) The Defiance County Costs Recovery Standard for Hazardous Material Incidents, dated July 28, 1995, is hereby adopted as the standard for recovery of costs as it relates to hazardous material incidents for the Village.
(b) The Fiscal Officer is hereby authorized to submit invoices for labor, equipment and supplies, whenever applicable, to the Defiance County Emergency Management Agency (EMA), in the event that there is a multi-agency response, and the Defiance County EMA shall act as the central billing agency.
(c) If a hazardous material incident occurs entirely within the Village, and if the Defiance County EMA is not involved, then the Fiscal Officer is authorized to submit a bill to the responsible party for costs of labor, equipment and supplies used during the incident.
(d) A true copy of the Defiance County Costs Recovery Standard for Hazardous Material Incidents, dated July 28, 1995, is attached to original Resolution 95-18, passed November 20, 1995, and made a part hereof by reference. Copies of such Standard may be obtained, at cost, from the Fiscal Officer.
