13-1-3: MINIMUM REQUIREMENTS:
The following are minimum requirements that must be fulfilled in order for any annexation to occur:
   A.   The territory to be annexed must be unincorporated and not incorporated into another municipality.
   B.   The territory to be annexed must be sufficiently contiguous to the village as is required by law.
   C.   Notice must be given to the proper authorities:
      1.   Notice must be given to the following entities in all annexations:
         a.   Fire Protection Districts: Notice of any proposed annexation must be served by certified or registered mail at least ten (10) days prior to the hearing to all fire protection trustees that are then providing services to the property to be annexed;
         b.   Library Districts: Notice of any proposed annexation must be served by certified or registered mail at least ten (10) days prior to the hearing to all library district trustees of the property to be annexed;
         c.   Township Boards: Notice of any proposed annexation must be served by certified or registered mail at least ten (10) days prior to the hearing to all board of town trustees of any township in which the property to be annexed lies; and
         d.   Highway Commissioners: Notice of any proposed annexation must be served by certified or registered mail at least ten (10) days prior to the hearing to any township commissioner of highways of any township in which the property to be annexed lies.
      2.   Notice may also be required to be given to, and which may not be limited to, any of the following:
         a.   Election authorities;
         b.   Post offices;
         c.   County recorders;
         d.   Property owners; and
         e.   Other municipalities.
   D.   The new boundary of the village as described in a petition for annexation and/or annexation ordinance must extend to the far side of any adjacent highway and must include all of every highway within the area to be annexed.
   E.   If an annexation is approved, the following must be filed with the office of the recorder of the county in which the annexed property is located prior to annexation and with the McLean County recorder's office within ninety (90) days after the annexation is approved:
      1.   A certified copy of the annexation ordinance;
      2.   An accurate map of the annexed territory; and
      3.   A plat of the annexed property prepared by a registered land surveyor or the village engineer 1 . (Ord. 2009-113, 9-21-2009)
