10-9-6: GENERAL REQUIREMENTS:
No fence shall be installed, erected or maintained except in strict compliance with the following requirements:
   A.   Dangerous, Noncompliant Fences: Any fence deemed to be a danger to the public safety, health or welfare by the administrating official shall not be permitted and shall be remediated or removed in the manner set forth in section 10-9-7 of this chapter. Any fence determined not in compliance with any provision of this chapter by the enforcement official shall be remedied according to the provisions of section 10-9-7 of this chapter.
   B.   Types Of Fences:
      1.   Metal Fences: Metal fences shall be treated and maintained in such a manner so as to maintain the fence in good structural condition and with an appearance that is aesthetically compatible with the type of fence it represents. The use of roofing material and other metals not commonly used for fencing is expressly prohibited.
      2.   Wood Fences: All wood fences shall be constructed with a wood that is commonly used for fencing and shall be painted, stained or preserved in such a manner so as to maintain the fence in good structural condition and with an appearance that is aesthetically compatible with the type of fence it represents. The use of plywood, pallets, salvaged lumber, and other wood not commonly used for fencing is expressly prohibited.
      3.   Masonry Fences: Masonry fences shall only be permitted with the written consent of the property owner adjacent to and abutting the side of the property where the fence shall be located.
      4.   Plastic Or Synthetic Material Fences: Any fence made of plastic or any synthetic material shall be treated and maintained in such a manner so as to maintain the fence in good structural condition and with an appearance that is aesthetically compatible with the type of fence it represents.
      5.   Barbed Wire Fences: Barbed wire fences are strictly prohibited except in the following instances:
         a.   The property is located in an agriculture zoning district, and the fence shall be used for fencing livestock animals.
         b.   The property is located in a commercial or manufacturing zoning district, and the fence shall be used for security purposes.
      6.   Electric Fences: Electric fences are strictly prohibited except in the following instances:
         a.   The property is located in an agriculture zoning district, and the fence shall be used for fencing livestock animals.
         b.   The property is located in a commercial or manufacturing zoning district, and the fence shall be used for security purposes.
   C.   Height: All fences shall comply with the height provisions set forth in title 11, chapter 7 of this code.
   D.   Fences Built On Public Property: Any fence on public property not expressly permitted by the village shall be removed, upon written notice by the village, within fifteen (15) days from the issuance date of the notice. Any fence that is not removed after due notice is given may be removed by the village at the rate set forth for abatement of nuisances found in section 5-1-1 of this code.
   E.   Maintenance Of Fences: All fences shall be maintained in such a manner so as to prevent rust, corrosion, deterioration or otherwise so as to be a public or private nuisance, dilapidated or a danger to adjoining property owners or the public.
   F.   Existing Fences: Any fence existing on the effective date hereof may not be enlarged, extended, or replaced except in strict compliance with this chapter. (Ord. 2009-108, 9-8-2009)
