9-4-7: REMEDIES FOR DELINQUENCY:
If payment is not received by the first day of the next billing cycle, the Village may proceed in any of the three (3) following manners, either individually or in combination thereof: (Ord. 2008-04, 2-4-2008)
   A.   Lien Provisions: Notice of such delinquencies shall constitute liens upon the real estate for which such service is supplied, and the Village Clerk is hereby authorized and directed to file sworn detailed statements showing such delinquencies in the Office of the County Recorder of Deeds, and the filing of such statements shall be deemed notice of the lien for payment of the service rendered. This statement shall contain the legal description of the premises served, the amount of the unpaid bill, the date when such amount became delinquent, and a notice that the Village claims a lien for this amount as well as for all charges subsequent to the period covered by the bill. In the event the charges for such services become delinquent, the Village Clerk, Village Collector or a duly authorized designee of either is hereby authorized and directed to cause notification to be given in writing to the owner of the premises, the occupant thereof, and the user of the service that such delinquency exists and that services shall be discontinued without further notice.    B.   Foreclosure Of Lien: Property subject to a lien for unpaid charges shall be sold for nonpayment of the same, and the proceeds of the sale shall be applied to pay the charges, after deducting costs, as in the case of the foreclosure of statutory liens. Such foreclosure shall be by bill in equity in the name of the Village. The Village Attorney is hereby authorized and directed to institute such proceedings in the name of the Village in any court having jurisdiction over such matters against any property for which the bill has remained unpaid thirty (30) days after it has been rendered.
   C.   Civil Action: At the election of the Superintendent of Public Works or the Village Board of Trustees, the Village may file civil action in the court of appropriate jurisdiction to recover any amounts due for services rendered for the waterworks and/or sewerage systems, plus costs of suit and reasonable attorney fees deriving from said action being brought.
