A. Property Owner Requirements: The following requirements are minimum requirements for all driveways located within the village rights of way, and said driveways shall be required to be in compliance at the expense of the property owner. All such driveways shall:
1. Be surfaced with an all weather, dust free material; and
2. Be maintained in a safe and reasonable condition.
B. Village Requirements: The following requirements are the responsibility of the village for all applicable driveways located within the village rights of way:
1. Any driveway that is destroyed, removed, altered or damaged as a result of work, construction or other conduct performed by the village shall be repaired or replaced to the same or similar condition the driveway was in prior to said occurrence.
2. The village shall not be responsible for any repairs, replacement or construction of any driveway located within the village right of way unless otherwise specified herein.
C. Existing Driveways: Any driveway existing on the effective date hereof may not be enlarged, extended, or replaced except in strict compliance with this chapter. (Ord. 2009-105, 9-8-2009)
