8-1-3: REVIEW PROCESS:
   A.   Administration: All petitions for sidewalk repair or construction shall be made to the streets and public utilities committee, submitted on a form approved by the village,**** and shall be subject to the approval of the board of trustees, and the determination shall be made by the board with regard to the availability of funds and the need for the proposed improvement.
   B.   Deposit And Costs:
      1.   After petition for sidewalk repair or construction, the streets and public utilities committee shall consider the project and deliver to the property owner or owners so requesting the work an estimate of the cost of the same. The property owners, within the time specified, shall deposit, in cash, an amount equal to fifty percent (50%) of the estimate of the project. The board of trustees shall then proceed to let contracts for the work. The total cost of such repair or construction shall be borne equally between property owner and the village.
      2.   Alternatively, the streets and public utilities committee may estimate the cost of the work under the assumption that the labor shall be provided by village forces. (Ord. 2009-11, 2-2-2009; amd. 2011 Code)
   C.   Refund Of Deposit: In the event a sidewalk project is not approved by the board of trustees after deposit of funds by a property owner, the funds so deposited shall be refunded without interest. After payment of all costs of construction, any pro rata amount of the deposit over and above fifty percent (50%) of the actual cost will be refunded pro rata to the property owners concerned with the project.    D.   Processing Request: A determination shall be made by the village board of trustees no later than the first regularly scheduled board meeting following fourteen (14) days after petition to the streets and public utilities committee. (Ord. 2009-11, 2-2-2009; amd. 2011 Code)
