The provisions of this chapter are intended to apply to situations where time and/or prolonged use have contributed to deterioration of the sidewalks in established developments of any zoning classification or, if no sidewalks are present, where the construction of sidewalks would be of mutual benefit to the community as a whole. These provisions shall not apply to situations where subdivision development or building improvements include new sidewalk construction or removal as a component of the overall construction.
