7-6-3: COMPRESSION RELEASE ENGINE BRAKE:
   A.   Definition: For the purposes of this section, the term "compression release engine brake" means any device installed or operating as a part of a diesel engine equipped vehicle which reduces the speed of said vehicle by altering the airflow within the engine causing the emission of compressed air from the exhaust of said vehicle.
   B.   Prohibited Use: The use of compression release engine brakes to brake or decelerate by any vehicle so equipped traveling within the corporate limits of the Village is hereby prohibited.
   C.   Affirmative Defense: It shall be an affirmative defense to a violation of this section that compression release engine brakes were or are used in circumstances where such use was necessary to avoid personal injury or an accident.
   D.   Signs Posted: The erection of signs conforming to the Illinois Department of Transportation standards shall be permitted by the Illinois Department of Transportation and placed in accordance with its standards and policies. If permitted by the Department of Transportation, such signs shall be placed at the following locations:
Route 136 west of U.S. 51 and east of 1400 East Road.
Route 136 east of the east corporate limit line, but west of 1600 East Road.
Vine Street (Old 51) north of the north corporate limits line, but south of 275 North Road.
   E.   Penalty: Upon conviction of a violation of this section, the court shall impose upon the violator a fine not less than one hundred dollars ($100.00) nor more than seven hundred fifty dollars ($750.00). (Ord. 2017-03, 2-2-2017)
