6-2-4-4: ANIMAL BITES:
   A.   Seizure Of Animal: It shall be the duty of the owner or person having custody of any animal that has bitten another person or animal to lock said animal in an enclosure until a licensed veterinarian may examine the animal and prescribe proper procedures. If such animal should die or show definite signs of illness, it shall be the duty of the owner or person having custody of the animal to turn the animal over to the county health office or village police department. Any animal which bites another person is hereby declared to be a public nuisance, and such animal may be apprehended and impounded by any police officer, animal warden, or other person authorized by the village, unless it attacks or bites a person while in the course of protecting a person being attacked or threatened.
   B.   Medical Attention Required: Should any public official or employee or other representative of the village be bitten by any animal and medical attention is provided for said bite, the owner of said animal shall be liable for any costs incurred for said bite unless it attacks or bites a person while in the course of protecting a person being attacked or threatened. The owner shall also be in violation of this chapter and subject to the penalties as determined in section 6-2-8 of this chapter. (Ord. 2008-37, 11-3-2008)
