6-2-2: DEFINITIONS:
BITTEN: Seized with the teeth or jaws so that the person or thing seized has been nipped or gripped and has been wounded or pierced.
CAT: Includes all animals, male and female, of the feline species.
CRUELTY TO ANIMALS: Beat, torment, starve, overwork or otherwise abuse or treat any animal in a commonly recognized cruel manner.
DANGEROUS ANIMALS: Includes any of the following animals, including hybrids thereof: lion, tiger, leopard, elephant, ocelot, jaguar, cheetah, margay, mountain lion, lynx, bobcat, jaguarundi, civet, serval, hyena, bear, wolf, or coyote, any poisonous or life threatening reptile or any other animal commonly deemed fierce by society or the law. A life threatening reptile is any member of the crocodilian family or any constricting snake six feet (6') or over in length, such as a boa, python, or anaconda.
DANGEROUS DOG:
   1.   Any individual dog anywhere other than upon the property of the owner or custodian of the dog and unmuzzled, unleashed, or unattended by its owner or custodian that behaves in a manner that a reasonable person would believe poses a serious and unjustified imminent threat or serious physical injury or death to a person or a companion animal; or
   2.   A dog that, without justification, bites a person and does not cause serious physical injury.
DOG: Includes all animals, male and female, of the canine species that are four (4) months of age or older.
DOMESTIC ANIMAL: Includes, but is not limited to, dogs, cats, horses, mules, cattle, sheep, swine, or domestic fowl of the species of geese, ducks, turkeys, hens, barn fowls, guinea fowls or peacocks.
OWNER: Any person or persons keeping or harboring an animal or having it in their care or acting as its custodian or permitting an animal to remain on or about any premises occupied by such person(s). In the event that the owner, harborer, or keeper of any animal is a minor, the parent or guardian of such minor shall be responsible to ensure that there is compliance with all provisions of this chapter, and it shall be illegal for such parent or guardian to fail to prohibit any violation of this chapter by a minor.
RUNNING AT LARGE: Any dog or animal not restrained or under physical control by leash, chain, fence or other device, whether on or off the premises of the owner.
VICIOUS DOG: A dog that, without justification, attacks a person and causes serious physical injury or death or any individual dog that has been found to be a dangerous dog upon three (3) separate occasions. (Ord. 2008-37, 11-3-2008; amd. Ord. 2020-52, 8-20-2020)
