4-2-11: LICENSE RESTRICTIONS:
   A.   Sanitary Conditions:
      1.   All premises used for the retail sale of alcoholic beverages or for the storage of such beverages for such sale shall be kept in a clean and sanitary condition, and shall be kept in full compliance with the laws of the State of Illinois and the ordinance or resolution of this Village regulating the condition of premises used for the storage or sale of food for human consumption, as provided in the County Food Resolution approved September 14, 1948, as amended.
      2.   All employees shall be qualified under the said County Food Resolution.
   B.   Location Restrictions:
      1.   No license shall be issued for the sale at retail of any alcoholic beverage within one hundred feet (100') of any church, school, hospital, home for aged or indigent person, or for veterans, their wives or children, or any military station, provided, that this prohibition shall not apply to hotels offering restaurant service, regularly organized clubs, or to restaurants, food shops or other places where the sale of alcoholic liquors is not the principal business carried nor to the renewal of a license for the sale at retail of alcoholic liquor on premises within one hundred feet (100') of any church or school where the church or school has been established within such one hundred feet (100') since the issuance of the original license. In the case of a church, the distance of one hundred feet (100') shall be measured to the nearest part of any building used for worship services or educational programs and not to property boundaries.
      2.   Nothing in this section shall prohibit the issuance of a retail license authorizing the sale of alcoholic liquor to a restaurant, the primary business of which is the sale of goods baked on the premises if:
         a.   The restaurant is newly constructed and located on a lot of not less than ten thousand (10,000) square feet;
         b.   The restaurant costs at least one million dollars ($1,000,000.00) to construct;
         c.   The licensee is the titleholder to the premises and resides on the premises; and
         d.   The construction of the restaurant is completed within eighteen (18) months of the effective date of this amendatory act of 1998.
      3.   Nothing in this section shall prohibit the issuance of a retail license authorizing the sale of alcoholic liquor incidental to a restaurant if:
         a.   The primary business of the restaurant consists of the sale of food where the sale of liquor is incidental to the sale of food and the applicant is a completely new owner of the restaurant;
         b.   The immediately prior owner or operator of the premises where the restaurant is located operated the premises as a restaurant and held a valid retail license authorizing the sale of alcoholic liquor at the restaurant for at least part of the twenty four (24) months before the change of ownership; and
         c.   The restaurant is located seventy five (75) or more feet from a school.
      4.   Nothing in this section shall prohibit the issuance of a license to a church or private school to sell at retail alcoholic liquor if any such sales are limited to periods when groups are assembled on the premises solely for the promotion of some common object other than the sale or consumption of alcoholic liquors.    C.   Hours Of Operation:
      1.   Class A, AP, C, D, E And CLUB Licenses: It shall be unlawful to sell or offer for sale at retail, or to allow consumption on the premises any alcoholic beverage pursuant to the authority of Class A, AP, C, D, E and CLUB licenses respectively between the following hours: twelve o'clock (12:00) midnight and six o'clock (6:00) A.M., Monday through Friday; one o'clock (1:00) A.M. and six o'clock (6:00) A.M. on Saturday; see subsection C3 of this section for Sunday sales and subsection C4 of this section for sales on the day before Thanksgiving/Thanksgiving Day sales and New Year's Eve/New Year's Day sales.       2.   Class B Licenses: Holders of Class B licenses shall be permitted to sell or offer for sale at retail for consumption on the premises beer and wine between six o'clock (6:00) A.M. and eleven o'clock (11:00) P.M. Monday through Saturday; see subsection C3 of this section for Sunday sales. (Ord. 2011-09, 3-21-2011)
      3.   Sunday Sales:
         a.   Sunday Sale Of Retail Package Alcohol: Sale of any alcoholic beverage of retail package alcohol and not for consumption on the premises, pursuant to the authority of Class AP, D and E licenses shall hereby be permitted between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight on Sunday.
         b.   Sunday Sale Of Retail Alcohol For Consumption On The Premises Only: Sale of any alcoholic beverage of retail alcohol for consumption on the premises only, pursuant to the authority of Class A, Class AP, Class B, Class C and CLUB licenses shall be permitted between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight on Sunday. All establishments which choose to sell alcohol on Sunday for consumption on the premises shall serve food for consumption on the premises for at least fifty percent (50%) of the time when alcohol is served.          c.   Special Use Permit: Holders of Class A, Class AP, Class B, Class C and Class CLUB licenses shall be permitted to choose up to twelve (12) days per year to exercise a special use permit. The special use permit shall allow the licensee to serve alcohol for consumption on the premises one hour longer than normal license hours. The licensee shall notify the Liquor Commissioner in writing at least two (2) weeks prior to the Sunday which the licensee desires to exercise the special use permit. (Ord. 2015-12, 3-19-2015)
      4.   Sales On The Day Before Thanksgiving/Thanksgiving Day And New Year's Eve/New Year's Day: It is hereby authorized to have sales for consumption on the premises for Class A, AP, C, NFP, and CLUB licenses on the day before Thanksgiving leading into Thanksgiving Day morning and New Year's Eve Day leading into New Year's Day from the normal hours permitted until one o'clock (1:00) A.M.
