4-1-13: MINORITY OWNED BUSINESS ENTERPRISE APPLICATIONS:
The village hereby recognizes minority owned business enterprises (MOBE) in the village. To be eligible to be considered as a MOBE, a business must complete an application approved by the village**** which shall utilize the following criteria in order for the village to determine whether the applicant meets or exceeds the requirements to be certified and recognized as a village MOBE: (Ord. 2008-28, 8-18-2008; amd. 2011 Code)
   A.   The MOBE shall be a for profit enterprise, whose principal place of business is located within the village, which enterprise is owned, operated and controlled by an individual or individual(s) who is a member of a minority.
   B.   For purposes of this section, "minority" shall include women and/or anyone who is a U.S. citizen or lawful permanent resident with at least one-fourth (1/4) or twenty five percent (25%) minimum blood ethnic heritage from the following general minority groups: African-American, Asian-Indian American, Asian-Pacific American, Hispanic American and/or Native American descent.
   C.   A MOBE is owned, operated and controlled by a minority if the business is at least fifty one percent (51%) owned by such individual(s) or, in the case of a publicly owned business, at least fifty one percent (51%) of the stock is owned by one or more such individuals. Further, those minority individuals must control the management and daily operations.
   D.   To determine whether those minority individuals control the management and daily operations, consideration should be given to the following:
      1.   Supervision of day to day operations;
      2.   Supervision of personnel issues;
      3.   Authorization for acquisitions and expenditures;
      4.   Marketing and sales operations and promotions;
      5.   Authority and supervision of corporate governance; and
      6.   Other criteria as deemed appropriate from time to time by the administration committee.
   E.   In further consideration of the application of any eligible applicant, the village will consider documentation offered in support of the criteria established herein, together with verification of the lawful existence of the corporation, and certification that said corporate entity is in good standing within the state of Illinois.
