(A) The following activities are not in violation of this subchapter:
(1) The burning of leaves or other landscape waste and paper in a burn barrel between the hours of 7:00 a.m. and 7:00 p.m. Monday through Saturday; provided, that there shall be no burning on Sunday or on any state holiday as that term is defined in § 1-6 of the Elections Code, 10 ILCS 5/1-6;
(2) The burning of charcoal, clean untreated wood, and other cooking fuels customarily used in an outdoor grill, traditional food cooking devices, or campfires;
(3) Fires used for recreational or ceremonial purposes such as school pep rally fires, the celebration of scout activities, or wiener roasts provided that the following conditions are met:
(a) Only clean untreated wood or charcoal shall be used. Paper or petroleum products can be used for ignition purposes only;
(b) The fire shall not be ignited more than two hours before the recreational activity is to take place and shall be extinguished upon the conclusion of the activity;
(c) The pile to be burned shall be less than 1,000 cubic feet (for example: ten feet by ten feet by ten feet);
(d) The local Fire Department shall be notified 24 hours in advance if the pile to be burned is more than 125 cubic feet (for example: five feet by five feet by five feet);
(e) The fire shall not be for disposal purposes; and
(f) The fire shall not be within 25 feet of a pipeline, fuel storage area, or propane tank.
(4) The setting of fires to combat or limit existing fires, when reasonably necessary in the judgment of the Fire Chief of the village’s Fire Department;
(5) The burning of fuels for legitimate campfire, recreational, and cooking purposes, or in domestic fireplaces, in areas when such burning is consistent with other ordinances of the village and the laws of the state; provided, that no garbage or refuse shall be burned in such cases;
(6) The burning of waste gases, provided that all such flares shall be equipped with smokeless tips or comparable devices to reduce pollution;
(7) Small open flames for heating tar, welding, acetylene torches, highway safety flares, and the like;
(8) Open burning conducted in accordance with a permit granted by the state’s Environmental Protection Agency; or
(9) The open burning of household waste in a burn barrel between 7:00 a.m. and 7:00 p.m. Monday through Saturday; provided, that there shall be no burning on Sunday or on any traditional holiday including, but not limited to, Easter, Memorial Day, July 4, Labor Day, Thanksgiving, and Christmas.
(B) The following conditions apply to all exemptions:
(1) Burning shall be done during safe weather conditions. Burning shall not occur during high winds, temperature inversions, air stagnation, or when atmospheric conditions will not readily dissipate contaminants;
(2) Fires must be attended at all times until completely extinguished;
(3) Fires must be extinguished if they create a fire hazard, nuisance, pollution problem, or threat to public health;
(4) Fire lighting equipment adequate for the size of the fire shall be on-site and nearby during times of burning;
(5) Burning shall not be for disposal purposes;
(6) All burning shall comply with other federal, state, and local laws, rules, and ordinances;
(7) The burning does not create a visibility hazard on streets, alleys, and public walkways;
(8) The burning does not become a nuisance, annoyance, or discomfort to any other person by reason of the emission of smoke, fumes, fly ash, dust, soot, or noxious odor; and
(9) Burn barrels shall not be located within 25 feet of a building, propane tank, gas tank, or any other combustible materials.
