4-2-5: PROHIBITED CONDUCT:
   A.   No person shall cause or allow to be initiated or maintained any open burning which interferes unreasonably with enjoyment of life or property or which creates any of the following:
      1.   Private nuisance.
      2.   Public nuisance.
      3.   A hazard to public safety.
   B.   No person shall cause or allow to be initiated or maintained any open burning of any prohibited waste.
   C.   No person shall cause or allow to be initiated or maintained any open burning of any material on any day open burning is prohibited because of meteorological or air quality conditions or dangerous fire conditions 1 .
   D.   Determinations under this Section of private nuisance, public nuisance and a hazard to public safety shall be made by the Police Department. Determinations of dates to prohibit burning because of meteorological or air quality conditions or dangerous fire conditions shall be made by the Fire Chief or his designee. (Ord. 497-93, 8-9-93)
