4-2-4: BURNING PERMIT REQUIRED; CONDITIONS:
   A.   Permit Required: Open burning of agricultural waste, construction waste, commercial waste, demolition waste, domestic waste and industrial waste is allowed only when a person holds a valid permit issued by the city under the authority of the fire chief.
   B.   Fires Attended: All open burning shall be constantly attended until extinguished by a responsible person, as described in subsection C of this section, or expressly authorized agent.
   C.   Responsible Person Described: Each person who is in ownership, control or custody of the real property on which open burning occurs, including any tenant thereof, or who is in ownership, control or custody of the material which is burned, shall be considered a responsible person for the open burning. Any person who causes or allows open burning to be initiated or maintained shall also be considered a responsible person.
   D.   Extinguishment Of Burning In Violation: It shall be the duty of each responsible person to properly extinguish any burning which is in violation of any provision of this chapter.
   E.   Minimize Smoke Production: All burning shall minimize smoke production to avoid any creation of a nuisance or public safety hazard.
   F.   Guidelines For Burning: Each responsible person shall follow the guidelines below to promote efficient burning and prevent excessive emission of smoke:
      1.   Be sure that all combustible material is dried to the extent practical, including covering combustible material to protect material from accumulating high moisture content.
      2.   Loosely stack or windrow the combustible material in such a manner as to eliminate dirt, rocks and other noncombustible material and promote an adequate air supply to the burning pile and provide the necessary tools and equipment for that purpose.
      3.   Periodically restack or feed the burning pile and assure that combustion is essentially completed, prevent smoldering fires and provide the necessary tools and equipment for that purpose.
      4.   Have available sufficient water supply and tools and equipment necessary to extinguish the fire and to prevent spreading of the fire. (Ord. 497-93, 8-9-1993)
