4-2-2: DEFINITIONS:
When used in this Chapter, the following words and terms shall have the meanings ascribed to them in this Section:
OPEN BURNING: Any burning conducted so combustion air is not effectively controlled in that combustion products are not vented through a stack or chimney, including but not limited to burning conducted in open outdoor fires, common burn barrels and backyard incinerators.
PERMIT: A permit issued by the City of Heppner under the authority of the Chief of the Heppner Fire Department specifying the period of time during which open burning is allowed and what type of waste is to be burned.
PERSON: Any individual, corporation, association, firm, partnership, public or Municipal corporation, political subdivision, State or agency thereof or the Federal government or any agencies thereof.
WASTE TYPES: A. Agricultural Waste: Any material actually generated or used by an agricultural operation, excepting prohibited waste as defined below.
   B.   Commercial Waste: Any material except agricultural waste, construction waste, demolition waste, domestic waste or industrial waste.
   C.   Construction Waste: Any material actually resulting from or produced by a building or construction project. Examples of construction wastes are wood, lumber, paper, crating and packing materials used during construction, materials left after completion of construction and materials collected during cleanup of construction site.
   D.   Demolition Waste: Any material actually resulting from or produced by the complete or partial destruction or tearing down of any man- made structure or the clearing of any site for land improvement or cleanup excluding yard debris and agricultural waste.
   E.   Domestic Waste: Household material, which includes paper, cardboard, clothing, yard debris or other material actually generated in or out of a dwelling of four (4) or fewer family units on the real property appurtenant to the dwelling. Such material actually generated in or around a dwelling of more than four (4) family living units is commercial waste. Once domestic waste is removed from the property of origin, it becomes commercial waste.
   F.   Industrial Waste: Any material, including process waste, produced as a direct result of any manufacturing industrial process.
   G.   Prohibited Waste: Any wet garbage, plastics, wire insulation, automobile parts, asphalt, petroleum products, petroleum treated materials, rubber products, animal remains or animal and vegetable matter resulting from the handling, preparation, cooking or service of food or any other material which normally emits dense smoke or nauseous odors.
