§ 150.193 PERMIT REQUIRED; ANNUAL INSPECTION FEE.
   (A)   Permit. It is unlawful and an offense for any person acting for himself or herself or acting as agent, servant, employee, subcontractor or independent contractor of any other person, to operate or maintain a well within the town, or to work upon or assist in any way in the production or operation of any such well, without a permit having first been issued by the authority of the oil and gas inspector in accordance with this chapter.
   (B)   Annual inspection fee to operate.
      (1)   An annual inspection fee is hereby levied upon each well operated or maintained under a permit issued by the town; such fee as set by the Town Board of Trustees by resolution, payable to the town on or before the annual anniversary date of the issuance of any permit under this chapter.
      (2)   No permit for any well shall be considered valid for any year for which the annual fee has not been paid.
      (3)   Failure to pay any required permit fee within 30 days of a delinquent notice sent to the latest address provided by the permittee will result in cancellation of the permit.
