§ 94.05 KEEPING DOMESTIC LIVESTOCK AND SMALL ANIMALS.
   (A)   Domestic livestock, including, but not limited to, cattle, swine, fowl or horses, shall not be maintained, kept or raised within the town except within a district zoned for agriculture with the following exception. In areas zoned residential on any parcel having a residence and having a combined lot size of one acre or more, one horse may be kept. One additional horse per 22,000 square feet exceeding one acre excluding the structures and required front and side yards may be kept. Pens and structures housing the animals shall be more than 100 feet from any other residence. The enclosure and buildings or shelters for horses must be kept in a sanitary condition. No more than a total of five chickens, ducks, hamsters, chinchillas, guineas, pigeons and other similar size small animals or fowl may be kept in any zoning other than agricultural. Such animals shall be kept within an enclosure sufficient to prevent them from escaping therefrom, and all cages, hutches or houses shall be kept in a clean and sanitary condition and disinfected in such a manner and to the extent necessary to prevent odors or unsanitary conditions.
   (B)   Excluding horses, cattle, sheep, goats or other large animals may only be kept in a district zoned agricultural. No person shall keep any animals or fowl that create a nuisance. This section shall not authorize the keeping of any animal that is considered wild and non-domesticated.
   (C)   Provided that this will not apply to livestock shows, rodeos or circuses.
