§ 76.02 ABANDONMENT UNLAWFUL.
   (A)   Abandonment prohibited. It shall be unlawful for any person, firm or corporation to park, leave, or abandon, or cause to be parked, left or abandoned, any car, truck or other vehicle, which is not then in proper mechanical condition to be normally operated upon any public street, alley, thoroughfare or other public property within the town limits.
   (B)   Nuisance. It is unlawful and shall constitute a nuisance for any owner or occupant of any lot or real estate within the town to store motor vehicles, or any trailer, without a current vehicle plate as required by law for vehicles to use the public highway, that are abandoned, dismantled, partially dismantled, wrecked, junked, inoperative or discarded, or left about the town in places other than an authorized junkyard or other areas authorized by the Town Board of Trustees, and which tend to do any one or more of the following:
      (1)   Impede traffic in the streets;
      (2)   Reduce the value of private property;
      (3)   Create fire hazards;
      (4)   Extend and aggravate urban blight; or
      (5)   Result in a serious hazard to the public health, safety, comfort, convenience and welfare of the residents of the town.
   (C)   Exceptions. This section shall not apply to any vehicle enclosed within a building on private property or to any vehicle held, stored or parked in connection with a business enterprise lawfully licensed by the town or state, and on property operated in the appropriate business zone, pursuant to zoning laws of the town, nor shall this section apply to a town owned vehicle in an appropriate storage place maintained in a lawful place by the town.
