(A) Creation of office. There is hereby established the position of the position of Utilities Superintendent. Except as otherwise provided herein, the Utilities Superintendent shall have administrative supervision and direction over all city utility departments, including, but not limited to, the Water, Sewer, Street, Parks, Recreation Departments, with additional oversite responsibilities for other departments as determined by the Mayor with advice and consent from the City Council.
(B) Qualifications.
(1) The Utilities Superintendent need not be a resident of the city at the time of his or her appointment but shall reside within ten miles of the city limits within such reasonable time as the Council and Mayor may allow.
(2) The Utilities Superintendent shall possess all necessary licenses and/or certifications required by law in order to manage the Water, Wastewater, Street and Park Departments, and for any other departments designated by the Mayor and Council. In the event that the Utilities Superintendent lacks any necessary licenses, certifications and/or credentialing, he or she shall obtain said certifications in a timely manner after hire as allowable by law, but under no circumstances more than one year after hire, or be able to employ the properly licensed, certified and/or credentialed personnel within the parameters of the department budget(s).
(C) Compensation. The Utilities Superintendent shall receive compensation and allowances as the Mayor and Council may prescribe.
(D) General. A Utilities Superintendent shall be appointed in the event that there is more than one municipal department and the governing body determines that it is in the best interest of the municipality to appoint one official to have the immediate control over all the said municipal departments. The Utilities Superintendent may be removed at any time by a majority vote of the governing body. Any vacancy occurring in the said office by death, resignation or removal may be filled in the manner herein provided for the appointment of all municipal officials. The Utilities Superintendent’s duties over the following departments shall be as stated herein.
(E) Water Department. He or she shall have general supervision and control over the municipal water system and shall be responsible for its economic operation and prudent management with the coordination of the Water Commissioner. He or she shall be responsible for assuring that the day-to-day operations of the water system for which the Utilities Superintendent has responsibility are performing adequately and in such a manner as deemed by the Mayor and Council to be in the best interest of the city. Included in the said water system shall be the water system, the pump house, all machinery and appliances used in connection with producing and distributing water to inhabitants of the municipality. All actions, decisions and procedures of the Utilities Superintendent shall be subject to the general directives and control of the governing body. The Utilities Superintendent shall have the general control and supervisory authority over all employees of the water system which the governing body may from time to time hire to operate and maintain the said system. He or she shall make a detailed report to the governing body at least once every six months of the condition of the said water system of all mains, pipes, hydrants, reservoirs and machinery and such improvements, repairs and extension thereof as he or she may think proper. This report shall show the amount of receipts and expenditures on account thereof for the preceding six months.
(F) Sewer Department. He or she shall have general supervision and control over the municipal sewer system and shall be responsible for its economic operation and prudent management with the coordination of the Sewer Commissioner. He or she shall be responsible for assuring that the day-to-day operations of the sewer system for which the Utilities Superintendent has responsibility are performing adequately and in such a manner as deemed by the Mayor and Council to be in the best interest of the city. All actions, decisions and procedures of the Utilities Superintendent shall be subject to the general directives and control of the governing body. The Utilities Superintendent shall have the general control and supervisory authority over all employees of the sewer system which the governing body may from time to time hire to operate and maintain the said system. He or she shall make a detailed report to the governing body at least once every six months of the condition of the said sewer system of all mains, pipes, treatment facilities and machinery and such improvements, repairs and extension thereof as he or she may think proper. This report shall show the amount of receipts and expenditures on account thereof for the preceding six months.
(G) Street Department. The Utilities Superintendent shall have general supervision and control over the municipal street system and shall be responsible for all work on the streets, sidewalks, culverts and alleys of the municipality with the coordination of the Street Commissioner. The Utilities Superintendent shall perform such other duties as the governing body may require. It shall be his or her responsibility to see that gutters and drains therein function properly and that the same are kept in good repair. He or she shall, at the request of the governing body, make a detailed report to the governing body on the condition of the streets, sidewalks, culverts and alleys of the municipalities and shall direct his or her attention to such improvements, repairs, extensions, additions and additional employees as he or she may believe are needed to maintain a satisfactory street system in the municipality along with an estimate of the cost thereof. He or she shall have other duties as the governing body may direct.
(H) Parks Department. The Utilities Superintendent shall have general supervision and control over the Parks Department and shall be responsible for its economic operation and prudent management with the coordination of the Parks Commissioner. He or she shall be responsible for assuring that the day-to-day operations of the parks for which the Utilities Superintendent has responsibility are adequately performed and in such a manner as deemed by the Mayor and Council to be in the best interest of the city. All actions, decisions and procedures of the Utilities Superintendent shall be subject to the general directives and control of the governing body. The Utilities Superintendent shall have general control and supervisory control over all employees of the Parks Department, which the governing body may from time to time hire to operate and maintain said system. He or she shall make a detailed report to the governing body prior to budget time and following the end of the park season.
(I) Swimming pool. The Utilities Superintendent shall have general supervision and control over the day-to-day mechanical operations of the swimming pool for which the Utilities Superintendent has responsibility are performing adequately and in such a manner as deemed by the Mayor and Council to be in the best interest of the city. The Utilities Superintendent shall communicate on a daily basis with the Pool Administrator on the mechanical operations and assist the Pool Administrator as needed.
(J) Recreation Department. The Utilities Superintendent shall have general supervision and control over the day-to-day operations and maintenance of, but not limited to, the ballfields, swimming pool, tennis court and sand volleyball court. He or she coordinate all actions, decisions and procedures with the Recreation Department Committee and shall be subject to the general directives and control of the governing body. The Utilities Superintendent shall have general control and supervisory control over all employees of the Recreation Department, which the governing body may from time to time hire to operate and maintain said system.
(K) Powers and duties. In the performance of his or her role as Utilities Superintendent, the Utilities Superintendent shall have the following duties and powers.
(1) He or she shall have the power, subject to provisions of applicable law, and with guidance and direction of the Mayor, to employ, discipline and remove all non-elected employees of the city departments over which this position has oversite responsibilities.
(2) He or she shall insure the enforcement of all state, federal and local laws and ordinances within the city and within its extraterritorial jurisdiction insofar as is necessary to perform duties related to the Water, Wastewater, Tree and Grass Landfill, Waste, Street, Recreation and Park Departments, and any other departments set forth by the Mayor with advice and consent of the City Council.
(3) He or she shall be required to possess all required licenses and/or certificates necessary to carry out the requirements of each department for which he or she is responsible, and/or hire, engage, or otherwise procure the necessary employee(s) with said licenses and/or certificates.
(4) He or she shall be responsible for preparation and management of the budget for each of the departments for which he or she is responsible, and shall be expected to manage the departments adequately within the bounds of said budgets.
(5) He or she shall be responsible for assuring that the day-to-day operations of each of the departments for which the Utilities Superintendent has responsibility are performing adequately and in such a manner as is deemed by the Mayor and Council to be in the best interests of the city.
(6) He or she shall be responsible for attending the scheduled meetings of the City Council and presenting reports as to the activities of each department for which the Utilities Superintendent has supervisory responsibility when requested by the Mayor and/or City Council.
(7) He or she shall perform any other duties and exercise such other powers as the Mayor and Council may from time to time assign.
(L) Appointment and removal.
(1) The position of Utilities Superintendent shall be filled by appointment of the Mayor with consent of the majority of the City Council.
(2) He or she shall serve for periods of one year for a term corresponding with the terms of the other appointed officials of the city.
(3) He or she may be removed at any time upon notice given by the Mayor and with approval of a majority of the City Council.
