6-7-2: ESTABLISHMENT OF ELECTRICAL AND NATURAL GAS UTILITY:
The city commission hereby establishes within its municipal structure an electrical and natural gas utility. In order to create, operate and maintain this utility the commission grants to the city the necessary powers to do the following:
   A.   Purchase electrical energy from public and private electricity suppliers;
   B.   Purchase natural gas from suppliers, aggregators, marketers and producers;
   C.   Enter into contracts for the procurement, transmission, distribution, and metering of electrical energy and natural gas;
   D.   Sell electrical energy and natural gas to retail customers located within and without the corporate limits of the city who voluntarily choose this service;
   E.   Obtain necessary licenses to act as a municipal utility for selling electrical energy and natural gas to retail customers;
   F.   Take title to and aggregate electrical energy as an intermediary for sale to retail customers;
   G.   Arrange for the transmission and distribution of electrical energy and natural gas to retail customers;
   H.   Provide for the metering and billing of electrical energy and natural gas sold to retail customers;
   I.   Establish rules for the operation of a municipal utility engaged in the business of retail sale of electrical energy and natural gas;
   J.   Acquire property needed to supply electrical energy and natural gas to its retail customers, including condemnation proceedings if necessary; and
   K.   Do all things necessary and proper for the creation, operation and maintenance of a public utility engaged in the business of the retail sale of electrical energy and natural gas. (Ord. 2841, 6-1-1998)
