The regulations provided in this section shall apply only to the area described in that certain “Interlocal Agreement and Lease” executed by and between the City of Heath and the City of Dallas on November 4, 2004. The area described is the area along the shoreline of Lake Ray Hubbard owned by the City of Dallas, by agreement subject to the use and control of the appropriate ordinances of the City of Heath. Such area is that area between the line condemned by the City of Dallas in acquisition of Lake Ray Hubbard and the actual waterline of the lake as it may exist from time to time. Unless otherwise stated within this section, the regulations apply to the take area without regard for whether the take area has been subleased to private property owners or not.
(A) It shall be unlawful for any person to possess, sell, or discharge any fireworks in the area covered by this section. FIREWORKS
as used in this section shall be as defined in Article 9205, Texas Revised Civil Statutes. Public display of fireworks as provided in that statute shall be allowed if permitted as provided therein only with the specific written permission of the City Council of the city. In granting such permission, the Mayor may impose any reasonable conditions, restrictions, or prerequisites on or prior to the issuance of such permission.
(B) No person shall discharge any firearm, rifle, shotgun, automatic rifle, revolver, pistol, or launch an arrow or like projectile from a crossbow, longbow, blowgun, or like launching device onto or within the area covered by this section or onto, across or from any portion of Lake Ray Hubbard on, over or across any portion of the area covered by this section. The area covered by this section is a public place as defined by the Texas Penal Code.
(C) No person shall discard any waste or litter within the area covered by this section, other than in garbage containers in the area for such purpose.
(D) No person shall store or discard any gasoline, oil, or other flammable or combustible liquid on the area covered by this section.
(E) It shall be unlawful for any person to abandon or leave unattended personal property of any kind within the area covered by this section unless specifically authorized in writing to do so by the City of Heath and the City of Dallas. Any personal property left within the area in excess of 48 hours will be impounded by the city if not reclaimed within ten days after such impoundment fees, will be sold at public auction or disposed of as many be directed by the City Council.
(F) It shall be unlawful for any person to camp within the area covered by this section. For purposes of this section , the term CAMP
shall mean the utilization of or display of items customarily and normally used for camping purposes including, but not limited to the following items: camping trailers, tents, cots, sleeping bags, and beds.
(G) It shall be unlawful for any person to leave, stand or park a house trailer or recreational vehicle except at areas designated for camping and subject to the provisions of division (F).
(H) It shall be unlawful for any person to possess of consume alcoholic beverages in the areas designated by this section that are not subleased.
(I) Except as hereinafter provided, it shall be unlawful for any person to operate or park a motor vehicle in the area covered by this section. Except as otherwise provided in division (N), motor vehicles may be parked only in areas designed by signs in that portion of the area covered by this section designated as “Terry Park.” For purposes of this section, the term MOTOR VEHICLE
shall mean a self-propelled device in, upon, or by which a person or property is or may be transported or drawn on land. Motor vehicles used for maintenance of the area covered by this section are exempted from the provision of this division (I).
(J) It shall be unlawful for any person to ignite or maintain any open fire within the area covered by this section that is not subleased, except in fire pits or barbecue grills provided by the city.
(K) It shall be unlawful for any person to engage in disorderly conduct as that term is defined by the Tex. Penal Code.
(L) It shall be unlawful for any person to remove, mark, cut, break, or otherwise disturb live trees or plants located within the area that is not subleased covered by this section.
(M) It shall be unlawful for any person to be in the area designated as “Antigua Bay Point” during the hours from 10:00 p.m. to 6:00 a.m. daily.
(N) It shall be unlawful for any person to be in the area designated as “Terry Park” during the hours established in Chapter 90, Parks and Recreation, of the Code of Ordinances.
(O) It shall be unlawful for any person to be in the area that is not designated as “Terry Park,” “Antigua Bay Pont” or otherwise subleased covered by this section during the hours from 10:00 p.m. to 6:00 a.m. daily.
