ORDINANCE NO. 090106A
   AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HEATH, TEXAS, ADOPTING AND APPROVING THE 2008 S-1 SUPPLEMENT TO THE CODE OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
   WHEREAS, the July 2008 printing of the Code of Ordinances of the City of Heath, Texas (hereinafter referred to as the “Code” and the “City”) was adopted by Ordinance No. 080819B, effective August 19, 2008; and
   WHEREAS, the 2008 S-1 Supplement prepared by American Legal Publishing Corporation includes all ordinances of a general and permanent nature enacted since the July 2008 printing of the Code of Ordinances;
   WHEREAS, the City Council deems it necessary, expedient, and in the best interest of the City to adopt the 2008 S-1 Supplement to the Code as proposed and submitted by the City Attorney;
   NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HEATH, TEXAS:
   Section 1.   That the 2008 S-1 Supplement to the Code of Ordinances of the City of Heath as submitted by the City attorney, and as attached hereto, be and the same is hereby adopted by reference as if set out in its entirety.
   Section 2.   Savings Clause. All prior ordinances pertaining to the subjects treated in such Supplement shall be deemed repealed from and after the effective date of this ordinance except as they are included and reordained in whole or in part in such Supplement; provided, such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, or shall such repeal affect the provision of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain person, authorizing public improvement, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subject not contained in or covered by the Code.
   Section 3.   Effective Date of Ordinance. That this Ordinance shall take effect immediately from and after its passage and the publication of the caption hereof as the law and Charter of the City in such cases provides.
