(A) If the Director denies an application, the applicant may, within ten days after either:
(1) Notice of the denial was mailed to the current business address given by the applicant on the application; or
(2) Receiving notification of the denial at the Heath Department of Public Safety, submit in writing an appeal to the City Council. The City Council shall, within 30 days after the written appeal, accord to the applicant a hearing as to whether or not the application should be granted or denied. Both the applicant and the Director or his or her representative shall be presented and may be heard at the hearing.
(B) A denial of the application by the City Council shall be final, but shall not prejudice the right of the applicant to file a new application after a six-month waiting period from the date of denial by the City Council.
