(A) The Legislature has enacted legislation, codified as Tex. Health and Safety Code, Ch. 366, which authorizes a local government to regulate the use of on-site sewage disposal facilities in its jurisdiction in order to abate or prevent pollution, or injury to public health arising out of the use of on-site sewage facilities.
(B) In this chapter the purpose, definitions, rules and requirements shall be those set forth in the latest version of the design criteria for on-site sewerage facilities and 30 TAC, Ch. 285, if applicable, as adopted by the Texas Department of Health, or as may be amended in the future, and are hereby made a part of this chapter, as if the code was copied verbatim, subject to the deletions, amendments and additions prescribed by this chapter.
