§ 52.02 DEFINITIONS.
   For purposes of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   "ADD ON RATE." That rate amount above the GCR which in the discretion of the City Commission is reasonably required to recover all anticipated and unanticipated costs of the city in delivery of natural gas and, without limitation, will generate sufficient revenue for any personnel, maintenance, reserves, depreciation, overhead, capital improvements, bond or other debt service, and any other usual and customary operations and maintenance expenses of either public or private utilities to the extent permitted by law. It may include amounts reasonably calculated to promote economic development or to fund other projects or general program expenses should surplus funds from gas sales be needed to be transferred to the general fund or other funds of the city from time to time. The ADD ON RATE may be changed only by affirmative vote of the City Commission from time to time.
   "COAL FIELDS REGIONAL INDUSTRIAL PARK PIPELINE." That certain pipeline constructed by the city which is segregated from the remainder of the city's gas works and which serves the area of the Coal Fields Regional Industrial Park and contiguous or nearby properties in close proximity to the pipeline, if any, which may be opened for gas sales in the future discretion of the City Manager with oversight of the City Commission.
   "COMMERCIAL GAS." Natural gas used by non-manufacturing establishments or agencies primarily engaged in the sale of goods or services. Included, without limitation, are such establishments as hotels, restaurants, wholesale and retail stores and other service enterprises; gas used by local, state, and federal agencies engaged in nonmanufacturing activities.*
   "CONSUMER PRICE INDEX." The CPI-U for All Urban Consumers published periodically by the U.S. Bureau of Labor Statistics.
   "GAS COST RECOVERY (GCR) RATE." The full direct and indirect wholesale cost of natural gas to the city inclusive of any applicable ancillary costs or expenses, including but not limited to pipeline volumnmetric or other costs of transportation, cover costs, credit support obligations, imbalance charges, transactional costs, tariffs, line loss charges, surcharges, applicable taxes, metering costs, tap on fees, testing expenses, interest charges, bank charges, damages and other expenses. That rate may be calculated separately and apart for industrial, commercial and residential customers of the city for purposes of rate setting and shall be calculated separately for rate setting for industrial gas customers of the Coal Fields Regional Industrial Park Pipeline. Within the city limits and in areas other than those areas served by the Coal Fields Regional Industrial Park Pipeline, the GCR may be calculated on the basis of the costs associated with any primary source of gas supply and may not be based upon the cheapest source of supply or an aggregate of costs associated with all sources of supply. For the customers of the Coal Fields Regional Industrial Park Pipeline, the GCR shall be based upon the sole source contract for supply of natural gas to the pipeline but may also include any other direct or indirect costs relating to the provision of gas, including but not limited to costs associated with replacement gas in the event of disruption in that sole source of supply. The GCR shall be subject to recalculation at any time and from time to time by the City due to changing circumstances in the city's discretion.
   "INDUSTRIAL GAS." Natural gas used for heat, power, or chemical feedstock by manufacturing establishments or those engaged in mining or other mineral extraction as well as consumers in agriculture, forestry, and fisheries. Also included in industrial consumption, without limitation, are generators that produce electricity and/or useful thermal output primarily to support the above-mentioned industrial activities.*
   "RESIDENTIAL GAS." Natural gas used in private dwellings, including apartments, for heating, air-conditioning, cooking, water heating, and other household uses.*
