§ 159.04 PROCEDURE FOR ESTABLISHMENT OF HISTORIC DISTRICTS.
   The procedure for establishment of a historic district shall be as follows:
   (A)   Application. An application for the establishment of a historic district may be filed by the Building Inspector, the Board, the City Commission, or by a property owner within the proposed district or his authorized agent. The application shall be filed with the Board in such form and accompanied by such information as may be required by the Board.
   (B)   Recommendation by the Board. The Board shall hold a public hearing prior to approval or disapproval of the application. The Board shall cause notice of the proposed action to be given to the City Commission and shall otherwise furnish notice to property owners within the proposed district in the same manner as prescribed by law for notification of pending or proposed zoning map changes. The Board shall vote to approve or disapprove the application, stating in writing its reasons, and shall forward its recommendation to the Planning Commission. The Board and the Planning Commission may act in joint session for purposes of this Section.
   (C)   Recommendation by the Planning Commission. The Planning Commission shall hold a public hearing prior to approval or disapproval of the recommendation of the Board to grant or deny an application to establish a historic district. The Board shall cause notice of the proposed action to be given to the City Commission and shall otherwise furnish notice to property owners within the proposed district in the same manner as prescribed by law for notification of pending or proposed zoning map changes. The Board shall vote to approve or disapprove the recommendation of the Board, stating in writing its reasons, and shall forward its recommendation to the City Commission. The Board and the Planning Commission may act in joint session for purposes of this section.
   (D)   City Commission Action. Upon receipt of a proposed application for establishment of a historic district, and after receiving the recommendations of the Board and the Planning Commission, the City Commission shall vote to approve or disapprove the application within 60 days.
