§ 157.103 BOARD OF ZONING ADJUSTMENT.
   (A)   A Board of Zoning Adjustment is established which shall consist of three, five, or seven members, all of whom must be citizen members, and not more than two of whom may be citizen members of the Planning Commission. Members shall be appointed by the Mayor, subject to the approval of the Board of Commissioners. Each member shall be appointed for a period of four years, but the term of office of members first appointed shall be staggered so that a proportionate number serve one, two, three, and four years respectively.
   (B)   Members of the Board of Zoning Adjustment may be removed from office by the Mayor, subject to the approval of the Board of Commissioners, for inefficiency, neglect of duty, malfeasance, or conflict of interest upon written charges and after public hearing, as provided in KRS 100.217(8).
   (C)   Vacancies on the Board of Zoning Adjustment shall be filled within 60 days by the Mayor, subject to the approval of the Board of Commissioners. If the Mayor fails to act within that time, the Planning Commission shall fill the vacancy. When a vacancy occurs other than through expiration of the term of office, it shall be filled for the remainder of that term.
   (D)   The Board of Zoning Adjustment shall have the following powers:
      (1)   Administrative review. The Board of Zoning Adjustment shall have the power to hear and decide cases where it is alleged by an applicant that there is error in any order, requirement, decision, grant, or refusal made by the Administrative Officer in the enforcement of the zoning code. An appeal shall be taken within 30 days, as provided by KRS 100.257.
      (2)   Conditional use permits. The Board shall have the power to hear and decide applications for conditional uses in conformance with § 157.104, pursuant to KRS 100.237.
      (3)   Variances. Pursuant to KRS 100.241, the Board shall have the power to hear and decide on applications for variances as provided in § 157.105.
