§ 51.04 DISPOSAL OF SOLID WASTE.
   (A)   Open burning. Open burning of special waste, medical waste, classified waste, and hazardous waste is prohibited. No person or agent thereof may kindle or maintain any open fire or authorize any fire to be kindled or maintained without first obtaining a permit from the City Fire Chief or their designee. Any person found to have performed or participated in violation of this section will be prosecuted.
   (B)   Open dumping. Open dumping of solid waste, including bulky waste, on all lands (i.e., roadsides, hollows, rivers, streams, lakes, and the like) by any person is prohibited by KRS 224.40-100, including any amendments or revisions, and this chapter. Any person found to have performed or participated in violation of this section will be prosecuted.
   (C)   Hazardous waste and medical waste. As defined within this chapter, hazardous waste and medical waste will require special handling and shall be disposed of only in a manner authorized by state and/or federal regulations. The city does not maintain services for the proper handling and disposal of hazardous waste and medical waste. Any person, business or industry responsible for generating hazardous waste or medical waste shall be solely responsible for the proper storage, collection and disposal of hazardous waste. The accumulation of hazardous waste or medical waste on any property within the city limits without proper disposal shall be presumed to constitute a public nuisance along with any other violation of law, regulation and ordinance. Any person found to have performed or participated in violation of this section will be prosecuted.
