(A) Storage containers required. The occupancy or owner of every residential dwelling unit, agricultural, business, commercial, institutional and industrial establishment producing solid waste within the city limits shall provide sufficient and adequate containers for the storage of all solid waste except bulky waste and demolition and construction waste to serve each dwelling unit and/or establishment.
(B) Solid waste to be stored in a manner prescribed by ordinance. The occupant or owner of every residential dwelling unit, agricultural, commercial, business, institutional and industrial establishment shall place all solid waste to be collected in proper solid waste containers and shall maintain such solid waste containers and the area surrounding them in a clean, neat, and sanitary condition at all times. Solid waste shall be stored in a manner that will be kept free from insect and rodent infestation and will not create a fire hazard.
(C) Standards for residential storage containers. Residential solid waste shall be stored in carts. Carts shall be leak proof, water proof, and fitted with a fly-tight lid and shall be properly covered at all times, except when depositing waste therein or removing the contents thereof. In addition to the cart, residential solid waste customers may place two (2) bags, as defined in this chapter, next to the cart on the designated pick up day for disposal. Residential storage containers may be issued by the City or franchise and the cost may be prorated to the customer over a one year period in addition to the weekly residential cost. The customer may purchase or rent the cart from the franchisee. The franchisee will handle all issues relating to their carts and the residential customer will contact the franchisee directly regarding their carts including paying the franchisee for the rental or purchase of the carts.
(D) Standards for business, commercial, institutional and industrial use storage containers.
(1) All business, commercial, institutional and industrial establishments which generate solid waste shall be required to use bulk commercial containers from the city approved solid waste management collector for storage of the solid waste. Whether business, commercial, institutional or industrial establishments may or must use a compactor, approved incinerator, dumpster, or other commercial container for solid waste shall be within the sole discretion of the Director.
(2) The approved commercial container must be placed in a public right of way location in such a manner that the container can be immediately accessible to the waste collector, equipment and truck. The business, commercial, institutional and industrial establishments shall be responsible for the area surrounding the commercial container including the responsibility of having the commercial container unlocked to allow waste collectors to dump the waste.
(3) The commercial containers shall be placed on a concrete or asphalt surface that is clear of overhead electrical, cable and telephone wires or other overhead obstructions.
(4) All non-decaying materials that do not fit into the approved commercial container must be bundled, secured and placed directly against the container for expedient pick-up by the waste collector and shall be of such size and weight that does not cause the services or more than one waste collection person to handle. The containers shall be water proof, leak proof, and shall be covered at all times except when depositing waste therein or removing contents thereof; and shall meet all requirements as referenced in § 51.07.
(5) An enclosure to place the commercial container within must be approved by the Director prior to use and issuance of certificate of occupancy and business occupational license for the location. If an approved enclosure is used, the business, commercial, institutional and industrial establishment shall keep the enclosure, and any doors or other mean of entrance, in good working order.
(E) Placement of air tight containers. No owner, occupant, tenant or lessee of any building or dwelling may leave outside the dwelling or building, in a place accessible particularly to children, any abandoned or unattended air tight containers (i.e., icebox, refrigerator, or other receptacle that has an airtight door) without first removing the door and prior to 12 hours from the pick-up time of the goods by the waste collector.
(F) Storage containers not in compliance. Solid waste containers that do not meet the specifications as outlined in this chapter shall be considered waste and may be collected together with their contents and disposed of by the waste collector.
