5-3-7: FALSE ALARMS PROHIBITED; PENALTIES:
   A.   No alarm user shall cause or allow a false alarm.
   B.   1. The intentional activation of a fire, burglary or robbery alarm system for the purpose of summoning a fire district, law enforcement personnel, or other public emergency service for other than actual fire, burglary or robbery, or a life threatening emergency situation, shall be punishable as a misdemeanor.
      2.   The failure of an alarm company or alarm company employee to notify the fire district or law enforcement agency servicing the city of Hayden of the cancellation of an alarm signal shall be punishable as a misdemeanor.
   C.   The third false alarm, and each subsequent false alarm, from the same location or alarm system within a six (6) month period, continuously and cumulatively until a six (6) month period free of false alarms has been achieved, resulting from equipment malfunction, improper installation or maintenance of equipment, or human error or negligence, shall obligate the occupant/owner to pay a service fee as set forth in a resolution adopted by the city council, which shall become due and payable no later than thirty (30) days after the date of the occurrence.
   D.   The occurrence of more than five (5) accidental or unintentional false alarms within any six (6) month period, continuously and cumulatively until a six (6) month period free of false alarms has been achieved, shall constitute a violation of this chapter. (Ord. 335, 1-28-2003)
