§ 32.18 PROCEDURE FOR DESIGNATION OF HISTORIC SITES.
   (A)   Application.
      (1)   Applications for designation must be made to the Historic Preservation Advisory Board.
      (2)   The Historic Preservation Advisory Board may require that such an application be made in such form as specified by the Historic Preservation Advisory Board.
      (3)   Application shall be made only by the owners of 100% of the historic site for which an application is submitted.
   (B)   Historic Preservation Advisory Board review.
      (1)   The Historic Preservation Advisory Board shall review the application for conformance with the criteria for designation established in § 32.17.
      (2)   The Historic Preservation Advisory Board shall consider the application at a regularly scheduled or special meeting and shall forward its recommendations to the Board of Trustees. Each such designation recommendation shall include a description of the characteristics of the site which justifies its designation and shall include a legal description of the location and boundaries of the historic site. The designation recommendation may also indicate alterations that would have a significant impact upon, or be potentially detrimental to, the historic features of the site. Any such designation shall be in furtherance of and in conformance with the purposes and standards of this subchapter.
      (3)   The Historic Preservation Advisory Board shall notify the Town Superintendent within seven days of any decision approving or disapproving an application.
   (C)   Board of Trustees action.
      (1)   Unless an application is withdrawn by the applicant within 60 days of the date of the Historic Preservation Advisory Board’s decision, the Board of Trustees shall hold a public hearing on the application.
      (2)   Written notice of the public hearing shall be mailed to the owner no later than ten days prior to the public hearing.
      (3)   The Board of Trustees shall review the application for conformance with the criteria for designation set forth in this code, and by shall by resolution approve, modify and approve or disapprove the proposed designation.
      (4)   The Board of Trustees shall advise the Historic Preservation Advisory Board of its decision regarding the designation.
   (D)   Recordation. Within 30 days of designation approval by the Board of Trustees, such designation will be recorded with the County Clerk and Recorder.
