§ 152.05 CURBLINES AND TREE SETBACKS.
   (A)   Curbs.
      (1)   Specifications.
         (a)   All curbs hereafter constructed throughout the town shall be constructed at established grades and at certain uniform distances from property lines, such distances to be for the several streets and avenues throughout the town as follows:
            1.   On Colorado Avenue north of Chase Street, 15 feet from property line;
            2.   On Colorado Avenue, south of Chase Street, 12 feet from property line; and
            3.   On all streets which are 80 feet between property lines, curbs shall be constructed 25 feet from property line.
         (b)   On all streets which are sixty feet from property line, the curb shall be constructed fifteen feet from the property line, with the following exceptions:
            1.   On Fletcher Street, between Logan and Washington Avenues, curbs shall constructed ten feet from the property line;
            2.   On Logan and Washington Avenues, where curbs shall be constructed ten feet from property line;
            3.   On Strohm Street between Logan and Washington Avenues, where curbs shall be constructed ten feet from property line; and
            4.   On Logan Avenue from the north side of the right-of-way of the Burlington Northern Railroad to the north line of the town, where curbs shall be constructed 15 feet from the property line.

      (2)   Reconstruction according to lines established herein. Any person who hereafter builds or constructs any curb on any street or avenue in the town at a distance from a property line contrary to the provisions of this section applying to such street or avenue may be required by resolution of the Board of Trustees at any regular or special meeting, to tear out such curb and reconstruct same at the line as is laid down in this section.

   (B)   Trees.
      (1)   Specifications. All shade and ornamental trees hereafter planted or set out by property owners within the town shall be planted or set ten feet from property lines.

      (2)   Any further planting to comply. Any person who shall hereafter plant or set out any trees along streets or avenues in the town, contrary to specifications of this section, may be required by resolution of the Board of Trustees at any regular meeting to remove the trees to the required distance from the property line.

   (C)   Not applicable to curbs or trees already in place; exceptions. This section shall not affect the location of any shade or ornamental trees or the location of any curb already constructed within the town unless it appears to the Board of Trustees that such trees or such curbs are placed so as to cause interference with adjoining property owners or so as to seriously mar the appearance of any such street or avenue and in such event any person may make complaint to the Board of Trustees and the Board of Trustees may, upon hearing such complaint and reply thereto, order the shade or ornamental trees or curb to be moved or to be torn out and rebuilt at the proper distance from the property line as laid down in this section.
