(A) Appointment.
(1) The Board of Trustees, at its first regular meeting after each biennial election, shall appoint some qualified person as Town Clerk.
(2) In case a vacancy should occur in the Office of Clerk, the Board of Trustees shall appoint a Clerk for the unexpired term.

(B) Oath. Before entering upon oath the duties of the office, the Clerk shall take an oath of office.

(C) Duties. The Town Clerk shall perform the following duties.
(1) The Clerk shall attend all meetings of the Board of Trustees and shall make true and accurate record of all of the proceedings.
(2) The Clerk shall keep true and accurate record of all rules, ordinances and resolutions made and passed by the Board of Trustees and shall, by his or her signature, certify any rules, ordinances and resolutions passed by the Board of Trustees.
(3) The Clerk shall be custodian of all of the town’s records, except criminal justice records made and maintained by the town’s Police Department; he or she shall keep such records open for public inspection at reasonable times as provided by law.
(4) The Clerk shall be the custodian of the town seal.
(5) The Clerk shall supervise the registration of voters for municipal elections and the administration of the elections.
(6) The Clerk shall supervise the issuance of all licenses, authorization of building permits and other city licenses or permits.
(7) The Clerk shall perform any other duties prescribed in state statutes, local ordinances or by the Board of Trustees.

(D) Removal.
(1) By the vote of four Board members, the Clerk may be removed from office.
(2) No such removal shall be made without a charge in writing and an opportunity of hearing being given, unless the Clerk moves outside the limits of the town.
(3) Inability of the Town Clerk to perform his or her duties without conflict with the duties of the Town Treasurer may be grounds for removal.
