Town streets, except for any state highways, are open for OHV use under the following conditions and restrictions.
(A) The OHV must be registered as required by C.R.S. §§ 33-14.5-101 et seq., and the validation decal issued by the state must be displayed.
(B) The OHV must have in full force and effect a complying policy of insurance as required of motor vehicles under the terms of C.R.S. §§ 10-4-601 et seq. Proof of insurance is required to be with the vehicle at all times.
(C) The OHV operator is licensed driver 18 years of age or older.
(D) Only one person may ride an ATV unless the ATV is designed for two riders and there is footrest and handholds for each rider. No passengers will be allowed under the age of six years or 60 pounds or according to the state regulations regarding car seat restraints. A UTV may carry one to four persons, as designed. All seats must be forward facing, and seatbelts are required to be in use. (E) The OHV operator must obey all state and town traffic laws; OHV must yield right-of-way to all other street traffic and pedestrians, but otherwise shall be operated in the same manner as any other vehicle.
(F) No three-wheel OHV-type vehicles are allowed on town streets.
(G) The operator of an OHV may not exceed the posted speed limit or a maximum speed of 35 mph.
(H) OHV operators may not travel on town sidewalks, except for when performing routine sidewalk maintenance, examples being snow removal or sweeping.
(I) The operator of an OHV on legal routes shall have all the rights and duties applicable to the driver of any other vehicle under the provisions of state statutes and laws, except when those provisions cannot be reasonably applied to OHVs and except as otherwise specifically provided for in state statutes.
(J) No motor vehicles that have been modified to be used as OHVs are permitted.
