8-3-15: FENCES 1 :
   A.   All pools shall be completely enclosed by a fence erected along the periphery of the pool and any immediately adjacent pool walk, deck or terrace area appurtenant to the pool; provided, however, that any such fence shall meet the yard requirements set forth in title 9 of this Code. In addition, no such fence shall be located in or on an easement and must be no farther than fifteen feet (15') from the edge of the pool and no closer than three feet (3') to the edge of the pool. A fence may start at and be connected to the house, encircle the pool and return to and connect to the house, provided that the distance between the house and the edge of the pool is no greater than twenty five feet (25') and that any exterior door leading from the house to the pool must be equipped with an audible alarm.    B.   All fence openings or points of entry into the pool area enclosure shall be equipped with gates and all gates shall be equipped with self-closing and self-latching devices placed at the height of four feet (4') and shall be so placed as to be inaccessible to small children. Fence and gates shall be a minimum of four feet (4') and a maximum of five feet (5') in height above the surface of the ground as measured along the fence line, and shall be of the open type and shall be wrought iron or similar alternate material as approved by the Village. Stockade fences are not permitted. All fence posts shall be decay or corrosion resistant and shall be adequately braced below grade (minimum of 42 inches) in a concrete base.
   C.   Berms are not permitted adjacent or near to the pool as a means of denying entry into the pool area or for any other purpose, nor is a fence permitted on top of a berm. Any landscaping inside a swimming pool fence must be so located as not to contribute to the contamination of the pool water. Landscaping shall be provided outside the fence to screen the fence from the view of the neighbors.
   D.   All applications for a building permit shall also be deemed an application for a fence permit. Such applications shall be accompanied by a grading plan and a plat of survey which indicates the placement of the fence, pool walk, pool and all other accessories to be installed or constructed, in addition to the other requirements set forth in applicable Village codes and ordinances.
