7-2-8: STANDARDS FOR RIGHT-OF-WAY TREE PLANTING PROGRAM:
   A.   Standards For Right-Of-Way Tree Planting Program:
      1.   At the sole discretion of the Village, the Village will provide a program to residents in the spring and fall, whereby residents can participate in the Right-of-Way Tree Planting Program.
      2.   Tree plantings in right-of-way are allowable only in neighborhoods with underground drainage within the right-of- way (storm sewer).
      3.   Tree plantings are not allowed in right-of-way with ditch drainage systems and/or driveway culverts.
      4.   Trees are not permissible in areas where they can be an obstruction to drainage.
      5.   No tree can be planted within the Village right-of-way by residents or a contractor hired by residents unless done pursuant to the requirements of this section.
   B.   Process To Participate In Right-Of-Way Tree Planting Program:
      1.   Plantings must be approved by Village and meet the Village's approved Right-of-Way Planting List referenced below, which may be modified from time to time:

Note:
   1.    These trees produce acorns.
   2.   Applicant must submit an application for the Right-of-Way Tree Planting Program to the Village.
   3.   Applicant must submit site sketch denoting proposed location of tree(s). Sketch must include all other items in the area (fire hydrants, street lights, driveway aprons, sidewalks, etc.).
   4.   There will be no fee for this program, aside for the cost of the tree(s) to be planted which shall be paid by the applicant prior to the planting of the tree.
   5.   Upon receiving approval, the Village will add tree(s) to list to be planted each spring and fall by a contractor selected by the Village.
   C.   Required Spacing And Location Of Tree(s):
      1.   Trees shall be spaced approximately fifty feet (50') apart, unless otherwise approved.
      2.   Trees cannot be placed in locations where they impair visibility at driveways and street intersections or block street signage.
      3.   Trees shall not be placed over underground Village utilities or watermain or sanitary sewer.
      4.   Trees shall be placed equidistant between the curb and sidewalk, or as approved.
      5.   Trees shall have a minimum caliper of 2.5 inches to three inches (3").
      6.   Trees can only be planted in Village right-of-way and cannot be planted along private roads or on private property as part of this program.
      7.   The Village has the ultimate decision on where trees will be planted.
   D.   After The Trees Are Planted:
      1.   The Village is not responsible for watering the new tree(s).
      2.   The trees shall not be re-planted to a different location in ROW or on private property.
      3.   The Village will be responsible for trimming trees for sight-line safety and removing trees, if they die or become a hazard, in the sole discretion of the Village.
      4.   The Village is not responsible to replace the tree(s). (Ord. 1790-17, 9-25-2017)
