4-8-12: PENALTIES:
   A.   Any person who smokes in an area where smoking is prohibited under the provisions of this chapter shall be guilty of an offense punishable by:
      1.   A fine of not less than two hundred fifty dollars ($250.00) for a first violation.
      2.   A fine of not less than five hundred dollars ($500.00) for a second violation.
      3.   A fine of not less than seven hundred fifty dollars ($750.00) for a third and subsequent violation(s).
   B.   Any person who owns, leases, manages, operates, or otherwise controls a public place or a place of employment that knowingly permits smoking in an area where smoking is prohibited under the provisions of this chapter, shall be guilty of an offense punishable by:
      1.   A fine of not less than one thousand dollars ($1,000.00) for a first violation.
      2.   A fine of not less than two thousand five hundred dollars ($2,500.00) for a second and subsequent violation(s).
In addition to the above criminal penalty, any such violation may result in the imposition of a fine, suspension or revocation of any business or liquor license issued for the premises on which the violation occurred.
   C.   Each day that any violation of this chapter shall continue shall constitute a separate offense. (Ord. 1188-06, 10-23-2006, eff. 1-1-2007)
