1-5-6: STANDING RULES OF PROCEDURE FOR SPECIFIED PUBLIC HEARINGS:
   A.   Rules Created: The procedural order of business to be observed for all public hearings conducted by the village board pertaining to annexation, zoning, and/or architectural review matters shall be as follows:
      1.   The mayor shall chair the public hearing;
      2.   The mayor may regulate the conduct of the proceeding, and may disallow any testimony or evidence in accordance with the rules;
      3.   All persons addressing the village board shall be given an opportunity to testify and present evidence, and an opportunity to ask questions;
      4.   All persons wishing to testify shall raise their hands, identify themselves by name, address and be sworn by the court reporter or notary public. All those testifying shall stand at the podium to address the village board;
      5.   Any member of the village board may ask questions of any person giving testimony at the public hearing;
      6.   The village board will first hear statements from the applicants or their attorneys and/or witnesses;
      7.   The village board will then hear statements or testimony from members of the public;
      8.   The chair will allow cross examination of the applicants, their witnesses, and members of the public and any witnesses who presented testimony on behalf of the public (includes questions);
      9.   The applicant will be allowed to present rebuttal testimony to matters raised by the village or members of the public. Any witness presenting rebuttal testimony shall be subject to cross examination and/or questions by the public and the village board;
      10.   Testimony and evidence which is cumulative, repetitious, harassing, argumentative or irrelevant to the case being heard will be disallowed;
      11.   Cross examination of persons giving testimony must be relevant to the matters heard and be confined to the points raised during that person's testimony;
      12.   At the conclusion of the public hearing, the mayor will close the public hearing and no further testimony or evidence shall be taken, unless the mayor continues the hearing to a date specific for the purpose of taking further testimony and evidence or unless the village board reopens the public hearing pursuant to law;
      13.   Any member of the village board absent from all or a portion of a public hearing who certifies that he or she has read the transcript on any given matter may vote upon any question before the village board with respect to such matter.
   B.   Rules Of Procedure Applicable To Planning, Building And Zoning Commission, And Zoning Board Of Appeals: The rules of procedure for public hearings as set forth in subsection A of this section shall also apply to any public hearing pertaining to annexation, zoning, and/or architectural review matters conducted by the planning, building and zoning commissioner and zoning board of appeals. As applied in these instances, the term "mayor" shall be interchanged with "chairperson" and the term "village board" with the name of the board or commission conducting said hearing.    C.   Modifications To Rules During Public Hearings: The rules of procedure for public hearings as set forth in subsection A of this section may be modified by the president of the village board or the chairperson of the plan commission, zoning board of appeals, or the architectural review commission as necessary or appropriate to accommodate specific circumstances during a public hearing.
