3-2-6: INVESTIGATION OF APPLICANT:
   A.    Investigation Required: Upon receipt of application for a license, together with the accompanying license fee and surety bond, the city administrator shall determine if such application is in order as to content and execution. The city administrator shall then refer the application to the city council for review. Prior to full consideration by the city council, the application shall be referred to the police department for an investigation of the background and character of the applicant and any persons associated with the applicant in the conduct of the business proposed to be licensed. The city council may then conduct a hearing upon completion of the police department investigation and full opportunity shall be given to the applicant to be heard upon his application and of any other person who desires to speak for or against the granting of the application and license. The investigation and hearing, if required, among other things, should reveal the character and/or reputation of the applicant for a license and applicant's ability and willingness to comply with the terms of this chapter. Upon completion of the investigation and report to the council, and hearing, if required, the city council shall act and either approve or deny the issuance of said license on the basis of said investigation, hearing and report of the city council.
   B.    Change In Resident Manager: In the event a license holder is required by the terms of this chapter to have a designated resident manager, the license holder shall report the change of said resident manager to the city administrator and shall submit an application to the city administrator for approval of said resident manager. The city administrator shall then refer the application to the city council for review and investigation in the same manner as the investigation for a new applicant for license. (Ord. 171, 1-11-1982)
   C.    Investigation Expense: The applicant for a license shall be responsible for the cost of the investigation conducted by the police department in connection with the processing of the application for license. The police department, upon completion of said investigation, shall prepare a written statement of time and expenses incurred in conducting the investigation and shall transmit said statement to the city council at the time the investigation report is completed and filed with the city council. In connection with any application for a license, a minimum fee of one hundred dollars ($100.00) shall be charged to the applicant. All investigation fees shall be paid by the applicant prior to the issuance of a license if the application is approved by the city council. If the license is denied, all investigation fees shall be deducted from the amount deposited with the city administrator upon filing of the application and the balance of said amount to be then returned to the unsuccessful application.
